Terms & Conditions

Welcome to Live 4 Lax Recruiting LLC. These Terms and Conditions ("Terms") govern your use of our collegiate sports recruitment consulting services ("Services"). By engaging with our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

 

1. Services

​

1.1 Scope of Services: The Company offers consulting services to assist student-athletes in the collegiate sports recruitment process, including but not limited to, personalized consulting, recruiting strategy development, profile building, and communication with college coaches.

​

1.2 Customization: The Services provided will be tailored to the needs and goals of each student-athlete, as determined through initial consultations and ongoing assessments.

 

2. Fees and Payment

​

2.1 Consulting Fees: Fees for our Services are as outlined in your agreement with the Company. All fees are non-refundable unless otherwise specified.

​

2.2 Payment Terms: Payments are due as per the schedule agreed upon in your contract with the Company. Failure to pay on time may result in suspension or termination of Services.

​

2.3 Additional Costs: Any additional costs incurred during the recruitment process (e.g., travel expenses, application fees) are the responsibility of the client.

​

3. Client Obligations

​

3.1 Accuracy of Information: Clients must provide accurate and complete information regarding their athletic and academic background, including but not limited to transcripts, test scores, and athletic statistics.

​

3.2 Compliance: Clients must comply with all relevant rules and regulations of the NCAA, NAIA, or other governing bodies.

​

3.3 Participation: Clients must actively participate in the consulting process, including attending scheduled meetings and providing requested information in a timely manner.

​

4. Confidentiality

​

4.1 Confidential Information: The Company will maintain the confidentiality of all client information provided during the consulting process, except as required by law or with the client's express consent.

​

4.2 Data Protection: The Company will implement reasonable measures to protect client data from unauthorized access or disclosure.

​

5. Intellectual Property

​

5.1 Ownership: All materials provided by the Company, including but not limited to reports, strategies, and templates, are the intellectual property of the Company.

​

5.2 Use of Materials: Clients are granted a limited, non-exclusive license to use these materials solely for personal use in the recruitment process. These materials may not be distributed or used for commercial purposes without the Company's prior written consent.

​

6. Limitation of Liability

​

6.1 No Guarantee: The Company does not guarantee admission to any specific college or university or the receipt of any scholarship or financial aid.

​

6.2 Liability: The Company's liability for any claims arising out of or related to these Terms or the Services shall be limited to the amount paid by the client for the Services.

​

7. Termination

​

7.1 At-Will Termination: Either party may terminate the consulting relationship at any time, for any reason, by providing written notice to the other party.

​

7.2 Effect of Termination: Upon termination, all outstanding fees for Services rendered up to the date of termination shall become immediately due and payable. The Company will provide a final invoice to the client for any such fees.

7.3 Return of Materials: Upon termination, the client must return all Company materials and cease using any intellectual property provided by the Company.

8. Dispute Resolution

​

8.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the state of Florida, without regard to its conflict of law principles.

​

8.2 Arbitration: Any disputes arising out of or related to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

​

9. Amendments

​

The Company reserves the right to amend these Terms at any time. Clients will be notified of any material changes to the Terms. Continued use of the Services after such notice will constitute acceptance of the revised Terms.

​

10. Miscellaneous

​

10.1 Entire Agreement: These Terms constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior agreements and understandings, whether written or oral.

​

10.2 Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

​

10.3 Waiver: The failure of either party to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

​

11. Indemnification

​

11.1 Client Indemnification: To the fullest extent permitted by law, the client (and, where applicable, the client’s parent or legal guardian) agrees to indemnify, defend, and hold harmless Live 4 Lax Recruiting LLC, its owners, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) the client’s misrepresentation or omission of any material information provided to the Company; (b) the client’s violation of any NCAA, NAIA, or other governing body rule or regulation; (c) the client’s failure to follow advice or recommendations provided by the Company; or (d) any breach by the client of these Terms.

11.2 No Liability for Eligibility Consequences: The Company shall not be responsible for any loss of athletic eligibility, scholarship, or other consequence suffered by the client as a result of the client’s own actions, misrepresentations, or failure to comply with applicable rules and regulations, regardless of whether such actions occurred during or in connection with the consulting process.

12. Parental and Guardian Consent

​

12.1 Requirement for Minors: If the client is under the age of 18, a parent or legal guardian must review, execute, and agree to these Terms on the client’s behalf. By signing below or otherwise engaging with the Services on behalf of a minor, the parent or legal guardian: (a) represents that they have the legal authority to enter into this agreement; (b) agrees to be personally bound by all obligations set forth in these Terms; and (c) accepts joint and several liability for any breach of these Terms by the minor client.

12.2 Unenforceability Against Minors: The Company will not knowingly provide Services to a minor client without a corresponding parent or legal guardian signature. Any agreement entered into solely by a minor, without a parent or guardian co-signature, shall be voidable at the Company’s sole discretion.

​

By engaging with our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
